Mr. Malagiere is a Registered Patent Attorney with the United States Patent and Trademark Office and a commercial litigator and trial attorney.

A mechanical engineer by training, Mr. Malagiere worked as an engineer in the aerospace and manufacturing fields before entering law school. Mr. Malagiere has a specialty in machine design, machining methods and manufacturing.

Mr. Malagiere has legal concentrations in construction law, New York Mechanics’ Lien Law, New Jersey Construction Lien Law, New Jersey Local Public Contracts Law, bid protests, New York Local Finance Law, payment and performance bond claims, delay and impact claims, patent law, municipal law, election law, land use law before local boards and courts, Federal public contracts disputes governed by the Federal Acquisition Regulations and Federal Miller Act claims, Federal Civil Rights Law and claims under the New Jersey Law Against Discrimination as well as trial practice, appellate practice and general commercial litigation and commercial transactions including real estate and business transfers and restructures.

Mr. Malagiere is licensed and practices regularly in both state and federal courts in New Jersey and New York. Further, he regularly practices before the United States Patent and Trademark office prosecuting patent applications.

Mr. Malagiere has served as counsel to the Bergen County Freeholder Board, the City of Hackensack Zoning Board of Adjustment, the South Hackensack School Board, The Lyndhurst Planning Board and as special litigation counsel to numerous public entities. Mr. Malagiere focuses his practice in the following disciplines: representing small to midsize technology companies and private inventors before the United States Patent and Trademark Company, The Patent Trial and Appeal Board and United Sates District Courts; (ii) representing developers before land use boards and courts as well as in commercial transactions and corporate structuring; representing owners, general contractors and subcontractors in all type of construction disputes both public and private and in contract negotiations and project delivery system consulting; representing public bodies and boards in day-to-day governance and compliance as well as litigation.
